These terms govern your use of Find My Agent’s website and services. By using our services, you agree to these terms. We may update them from time to time; the current version is always available on our website, and it is your responsibility to review it. These terms are governed by the laws of New Zealand. If any provision is found to be invalid or unenforceable, it will be severed and the remaining terms continue in full effect.
Our service
Find My Agent is a service provider to vendors. We recommend a top-performing local agent (or agents) for you to consider — there is no cost to you and no obligation to meet or work with anyone we recommend. We are not a licensed real estate agent and do not provide real estate services or advice on the sale of your property; that is the role of a licensed agent, and you should seek independent legal advice before entering into any agreement.
Our recommendations are based on careful analysis of recent sales and agent performance in your area, using the details you provide via our form, by phone, or by email. We generally recommend two agents. We cannot guarantee that an agent will accept a referral, or that your property will sell, and it is your responsibility to choose the agent that best suits your needs.
Complimentary marketing
If you list with an agent we recommend, we provide a complimentary Facebook marketing campaign for your property at our cost, using material sourced from the agent’s advertising. These campaigns direct enquiries to the agent. Apart from this marketing, we do not provide real estate services.
Fees
Our service is free to vendors. We are paid a pre-agreed referral and marketing fee by the agent, only when your property sells. Agents cannot pay to be referred — every recommendation is made through an independent, impartial process based on market and agent data at the time of analysis.
Agreements with agents
Any agreement you enter into is between you and the agent or agency, not with Find My Agent. We are not responsible for the conduct, performance or fulfilment of that agreement, and any dispute is a matter between you and the agent. You engage an agent at your own discretion and risk, and agree not to involve us in any such dispute.
No warranty
Our website and services are provided on an “as is” basis, and your use is at your own risk. While we take care to keep information accurate and current, we make no warranties about its completeness, accuracy or availability. Our site may link to third-party websites we do not control, and we are not responsible for their content. We are not liable if the website is temporarily unavailable due to technical issues.
Intellectual property
All intellectual property in the materials on our website (including copyright and trademarks) belongs to us unless stated otherwise. You may not copy, reproduce, distribute, or create derivative works from our materials without our permission. By submitting a testimonial, you grant us permission to publish it.
Liability
To the extent permitted by law, Find My Agent and its directors, employees and representatives are not liable for any indirect, consequential or special loss, or for loss of data, profits, business, opportunity or reputation, arising from your use of our website or services. Where we are found liable, our total liability is limited to NZ$2,000. You agree to indemnify us against all claims, losses, costs and expenses arising from your use of our website or any breach of these terms.
